The IOC against the reform of CONI. At risk Tokyo 2020 and Milan-Cortina 2026

The bill to reform the sports system is contrary to the Olympic Charter which requires the autonomy of sport from politics. Hard official letter from the IOC to Giovanni Malagò.

Involved by the president of CONI, Giovanni Malagò who on July 30 sent a copy of the bill on the sports organization that is being discussed in Parliament to Losanna, the International Olympic Committee reacts, in an irrational way as it is not his habit to intervene on projects not yet turned into law, harshly with an official letter signed by James MacLeod, responsible for relations with the national Olympic committees, the NOC. The long letter lists the fundamental points of the reform that would violate the Olympic Charter. In the text of the proposal, the first article provides that the Government is delegated to adopt, within twelve months from the date of entry into force of the law, one or more legislative decrees for the reorganization of the Italian National Olympic Committee (CONI). The International Olympic Committee observes that, in order to respect the Olympic charter, "CONI should not be" reorganized "by unilateral decisions by the Government. CONI should be an autonomous and legitimately independent organization governed primarily by the Olympic Charter and by its own statute , within the framework of the applicable laws on the basis of which it is legally registered in the country.Its internal governance and its activities must be established and decided within the framework of its own Statute, and the law should not aim at a "micromanaging" of the its internal organization and its activities ". From Lausanne we also come to suggest what should be not only the correct text but the approach with respect to the five-circle rules. The decrees should be aimed not at reorganizing the National Olympic Committee but at supporting it in its activities according to some principles in full compliance with the Olympic Charter. It is a substantial difference that the IOC is ready to defend with all the weapons at its disposal which at the moment are only agitated when it reads "to avoid any unnecessary complications and / or further actions". The points of attention highlighted by the letter of the International Olympic Committee go further: the area of responsibility of a NOC cannot be limited to the Olympic activity, the national sports Federations cannot be completely autonomous with respect to the CONI to which they must be bound for the compliance with the Statutes and the Olympic Charter and, finally, an internal governance issue such as the number of mandates of CONI bodies cannot be decided by law but must be decided by the assembly itself of the National Olympic Committee. The IOC breaks down the pillars of the bill and rewrites it from head to toe by offering its willingness to work together since this week. If the government does not align the bill with the demands of Lausanne, it would expose the CONI to the sanctions envisaged if a national Olympic committee is hindered in its activity by the government of a country that can reach the suspension or withdrawal of the recognition of the Olympic committee itself . The consequence of a possible suspension would be the impossibility to participate in the Olympic Games, with the athletes forced to parade with the colors of the Olympic flag, and the prohibition to organize demonstrations in the frame of reference of the IOC. As a result, a delegation of athletes that would not represent Italy and even a possible reassignment of the 2026 Winter Games if the problem persists could arrive in a year at the Tokyo Olympics.
