After the tough stance yesterday Bode Miller against Head, the litigation has had in the last hours an important turning point: Judge David O. Carter said the lack of jurisdiction for lack of territorial jurisdiction of the court in Santa Ana appeal filed by Miller.
The 'lawyer of the US champion, Mark B. Seiger, said in an e-mail to the Associated Press that the appeal could be filed in Colorado, home to the headquarters of the US Head but "Miller and Bomber may decide not to spend additional money to oppose an international giant "also because apparently the Colorado law would not be so favorable to the thesis of the downhill skier like that in California.
For his part Head immediately made known the decision through his Facebook profile by writing: "Head won against Bode Miller. Head was brought to court by Bode Miller that challenged its obligations related all''accordo termination of the sponsorship contract into being in 2015. Bode Miller said he wanted to retire and asked for the personal favor of the termination of the contract with one year in advance in order to be able to sign a sponsorship agreement with un''altra company. Head agreed with his manager to release the commitments on the condition that if he changed his mind on the withdrawal could not compete until the end of the 2016/17 season with another material. Bode Miller agreed as indicated nell''accordo termination. Despite this agreement, Bode Miller did recently due to Head to cancel this agreement. "
Johan Eliasch, CEO of Head, commented on the decision of Judge Carter: "I am happy that the case has been archived and yet we reiterate that we would happily return to Bode Miller races this season, but this must be done with material Head ".
From a purely sporting point of view, in the afternoon, the technical director of the US team had made it clear that to return to Miller's team will have to give evidence of efficiency talking about "miraculous return"; "Should prove to be able to qualify for the World Cup with its results", continues Rearick as it emerges that in training of Copper Mountain carried on down from 30 seconds, Bode was often slower than its peers.
