The candidate for president Alessandro Falez doesn't like it: "Roda's fourth term is illegitimate"

The climate is warming around the federal elections on October 15th; the Roman businessman, officially off the track a few days ago, has his say on the "case" concerning the number 1 in office.

A clear and clear position, in view of an electoral confrontation that promises to be very tough. There are just over two and a half months to go before the appointment that, on October 15 in Milan, will determine who will lead the FISI towards the four-year Olympic period that will lead to the Milan Games Cortina 2026. There is only one candidate, so far , who has launched himself in the challenge to the outgoing president, Flavio Roda, and it is Alessandro Falez, who on 15 July officially announced his descent on the track. There is all the intention on the part of Roda to reapply for what would be his fourth term, even if the number 1 of via Piranesi has already made it known to consider only the next one as the third term. With a press release, Falez wanted to underline a situation which has now been discussed for weeks. "The current president has done a good job in his previous three terms and it would have been positive for the FISI if he could have continued for a quarter, maintaining a" management continuity "in view of the Olympic four-year period - the words of the 67-year-old Roman businessman - However, Law 8/2018 has inserted the limit of three mandates in order to ensure the physiological representative turnover ". Roda, in fact, has already held the office for three terms and, even if his first office lasted less than four years (but, in any case, more than two years), this must be counted for the purposes of the limitation provided for by law, as clarified by the opinion of the College of Guarantee of CONI 6/2018, which states: "the mandates that have had a duration of less than the Olympic four-year period must be considered for the purpose of calculating the achievement of the threshold of three". Consequently, he cannot be re-elected even if there is all Roda's intention to reapply. There is also a transitional rule (13 February 2018) already applied for many councilors in the past electoral round, which allowed candidates to run for the fourth term, but which is not applicable to Roda as at the time of the law's entry into force it had not yet held the three mandates. The president in office points his conviction on the provisions of the Statute (Article 48 paragraph 4) and of the ROF, Federal Organic Regulations (Article 46 paragraph 4), which, in complying with the legislative provision, have however added two phrases (" within the maximum limit of three four-year mandates "and" within the maximum limit of three full four-year mandates "), which could distort the correct interpretation and application of the unequivocal rule of law which prevails, however, over the statute and the ROF. Furthermore, CONI has recently appointed an ad acta Commissioner to verify the correct adaptation of the federal charters to the CONI Statute and to the legislative provisions. In light of these considerations, a possible candidacy of Roda could be challenged to contest its admissibility - reads the note released by Falez - on the basis of the CONI Regulation of 9 March 2022, which provided for the Elective Assemblies an urgent procedure by both the Federal Prosecutor and another admitted candidate. This appeal would inevitably lead to the exclusion of the same candidacy before the vote in the Shareholders' Meeting. Furthermore, it could be challenged directly before the TAR (without having to go through sports justice, as required by a recent sentence of the Council of State, lan. 2320 of 07/04/2020). This appeal would also result in the forfeiture of the candidacy before the vote in the Shareholders' Meeting. “It is understandable that a person who has worked for 10 years dedicating himself full time to the FISI, wants to continue to deal with it - observes Falez - but I do not think that the good of the Federation can be achieved by leveraging the non-compliance with a rule of law. I hope that this misunderstanding will be cleared up quickly and that there are other valid people who can declare their candidacy these days. The hope is that an open and transparent debate will start soon among the candidates to compare ideas, models and projects. It would be an opportunity to bring out new ideas and new impetus, with the aim of allowing ski clubs to arrive at the election date with the widest possible awareness in order to choose the best candidate ".
