Special safety in case of an avalanche of who is to blame?

Another sore point of the matter is all the security chapter on off-piste skiing, ski touring and avalanche danger. Here there are two major issues: the landslides or avalanches that occur close to the pistes and those that occur in areas of so-called freeride.

The Italian law considers responsible managers of the lifts for what happens on the track but not for accidents that may occur in the off-piste routes served by the facilities themselves. The responsibility of managers is limited to areas open to the public, so the pistes. Fortunately it is rare that the phenomenon of avalanches involving the ski slopes and skiers, but if such an event occurs, the same questions arise: why did it happen? It was predictable? Avoidable? Who is responsible if an avalanche ends on a beaten track and overwhelms the unsuspecting skiers? Truly an obligation on the operator of there, and that is to verify and monitor the slopes that has a concession in order to secure them. In a nutshell manage a track close to a steep slope where there may be a dangerous accumulation of snow, has an obligation to do everything in his power to prevent the avalanche event. If he does not this obligation, in the event that comes off an avalanche, he is liable for damages caused to persons or property. There is more, it has the obligation to close the track is not only disaster occurred, but also as a preventive measure in all those cases where it is logical to expect the harmful event. What happens if instead the avalanche occurs in land of adventure that is outside the controlled areas? In recent years he has taken a lot of foot freeriding, fascinating discipline but risky. Here the responsibility lies totally on the skier. Each freerider assumes full responsibility for damages suffered himself or to other causes. Required for freeriding is you have brought the safety equipment consisting of avalanche transceiver, shovel and probe, as for ski touring. Also highly recommended are an electronic locator GPS satellite and helmet. In case of accident, the fact of not being alone but being in the company of other skiers freeriders can make the difference between life and death because they increase the ability to call for help and to receive timely help. Always a wise choice would be to rely on an expert guide, mountain guide and climbing instructor whose experience is fundamental in the choice of routes and in the knowledge of snow conditions.
